Article 1 – Field of application

These general terms and conditions apply unreservedly and without reservation to all sales made between Fa. “Stay nice and clean online” (hereinafter “stay nice and clean”) and all users (hereinafter “customer”) of the website www.schönsauberbleiben.de (hereinafter “website”).

Every purchase on the website is subject to all provisions of the general terms and conditions that are effective at the time the order is placed. By ticking the box provided, the customer confirms that he has taken note of the general terms and conditions published at the time of his order and that these are part of the contract.

Article 2 – Subject matter of the contract

The aim of these general terms and conditions is to define the online sales system for aprons

Accordingly, these general terms and conditions regulate:

  • the organization of the legal relationships between Keeping Nice and Clean and the customer.
  • the sales modalities between staying nice and clean and the customer (order, delivery, etc.).

Article 3 – Order procedure and modalities

3.1 – customer identification

The initiation of an order requires a connection to the website. The website can be accessed 24 hours a day, every day of the week, unless the service is subject to a malfunction.

To place an order, the customer needs a customer account. He can set this up in the “I WILL CREATE MY Nice and Clean – ACCOUNT” by providing the necessary information on the form provided for this purpose. By clicking on the “CONFIRM” button, the customer confirms that he is not using any false information or information from third parties. This will make your registration on the Stay Clean website effective.

On the occasion of his follow-up orders, the customer has the option of accessing his account directly by entering his ID and password.

The customer is responsible for storing, passing on and using his ID and password.

3.2 – placing the order

The customer who wishes to place an order selects products on the website. After the selection, the customer clicks on the “BUY” button. This is how the customer compiles his shopping cart.

After the customer has confirmed the shopping cart, the ordering process comprises four stages:

Delivery:

The customer names the delivery address and selects the desired delivery mode.
Before the binding confirmation of his order, the customer has the opportunity to make changes if he discovers that an error has occurred while recording the data.

The customer can only confirm his order after confirming his knowledge of these general terms and conditions by ticking the appropriate box.

3.2.2. Payment:

After confirmation, the customer selects his payment method and confirms his payment.

    • The following payment methods are available to the customer:
      • Payment by credit card: We accept Visa and MasterCard as credit cards.
        • When paying by credit card, the customer must first select the credit card with which he would like to pay. The customer is then asked to enter his credit card details in the fields provided.
      • Payment by PayPal: PayPal is a payment method that allows customers to pay for their order quickly and securely without having to pass on their bank details to retailers.
        • The bank details are stored once when the PayPal account is opened. They are then encrypted and stored.
        • If the customer already has a PayPal account, he can simply log in with his PayPal login.
        • If the customer does not yet have a PayPal account, he can still use this payment method. After submitting his order, the customer is redirected to the PayPal page, where he can register and enter his bank details.
        • With this payment method, your account is debited when the order is completed.
      • Payment by bank transfer: When making a bank transfer, you pay easily and conveniently in advance by bank transfer.
        • After placing the order, the customer receives the account details of Stay Clean, both online and by email. The name of the account holder must match the name of the person who is executing the order (last name, first name and address).
        • The ordered items are reserved for the customer for up to 72 hours.
        • As soon as the payment has been received on our account, the customer receives a confirmation email. Only then will the dispatch be prepared.
    • Combating fraud in online payments:

3.2.3. Confirmation:

The order is binding for the customer from its confirmation.

The confirmation of the order by the customer and its payment result in the receipt of a confirmation email, which is sent by Schön Sauber remaining to the email address given by the customer. It is only with this confirmation email that Schön Sauber remaining declares its acceptance of the customer’s offer to conclude the purchase contract.

The data that the customer has provided and which were saved by Schön Clean Stay with the order are evidence of all transactions that take place between Schön Clean Stay and the customer.

Staying Nice Clean is responsible for the electronic recording and processing of data relating to the customer’s order.

Article 4 – Made to measure

Staying Nice and Clean offers the customer the opportunity to adapt the products that he would like to order on the website as needed.

In the case of custom-made orders, there is no right of withdrawal in accordance with Section 312d Paragraph 4 No. 1 BGB.

Article 5 – Pricing Conditions

The prices on the website are in euros and include statutory VAT.

The product prices do not take into account:

  • the delivery charges, plus are invoiced at the sales price of the products (the delivery charges can be found on the website and are stated to the customer when placing the order), subject to the exceptions stated on the website.

The prices stated on the website are only valid in the online shop there.

Shipping costs:

  • For orders up to € 70, delivery costs are € 4.50
  • From 70 € order value, delivery is free.

Article 6 – Payment Terms

6.1 – Terms of payment

The customer can use the following means of payment to settle his order:

  • Credit card (Visa, Master Card)
  • PayPal
  • Transfer: When making a transfer, you pay easily and conveniently in advance by bank transfer. After placing your order, you will receive an email with our account details. We reserve the items from your order for up to 3 days. As soon as your payment has been received, the dispatch of your order will be prepared.

By providing his credit card number or bank details, the customer agrees to the amount of the order being charged to his credit card or bank account.

6.2 – Disruption of the payment process

Unless otherwise agreed, Schön Sauber Stay can refuse to deliver the products ordered by the customer until the entire invoice amount has been paid in accordance with the above conditions.

Article 7 – Availability of products

7.1 – General

Before the purchase process, the customer is informed about the availability of the products.

If processing periods are required between the recording of an order and its payment by the customer, it is possible that the products will no longer be in stock after this time.

In the event that the stock of products is partially or completely used up after the order has been confirmed by Schön Sauber Stay, Schön Sauber Stay reserves the right to withdraw from the contract. In this case, Schön Sauber remain obliged to inform the customer immediately by email and to reimburse him for payments already made.

Article 8 – Terms of delivery

8.1 – Delivery modalities

The products are delivered within Germany to the delivery address given by the customer when placing the order.

For deliveries to German islands, please ask our customer service about the costs.

8.3 – delivery times

The delivery times begin with the conclusion of the contract.

Schön Clean Stay cannot be held liable for a delay in delivery due to force majeure.

8.4 – Following the delivery

After delivery, the customer, who is a consumer within the meaning of Section 13 of the German Civil Code, is entitled to the statutory warranty rights in the event of defects. His statutory right of withdrawal remains unaffected.

If the customer is an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB), he must examine the product immediately after delivery by the seller, insofar as this is feasible in the ordinary course of business, and, if a defect is found, notify it to remain Nice and Clean immediately.

In particular, the entrepreneur checks before signing the delivery note

  • the visible condition of the package (s),
  • the condition of the products in or in the package (s),
  • the perfect conformity of the products with regard to the delivery note on the one hand and the goods ordered on the other.

If the entrepreneur fails to report, the product is considered approved, unless it is a matter of a defect that was not recognizable during the examination.

If such a defect appears later, this must be reported immediately after it is discovered by the entrepreneur; otherwise the product is considered approved even in view of this defect.

Timely dispatch of the notification is sufficient to preserve the rights of the entrepreneur.

Article 9 – Retention of title and transfer of risk

Staying Nice and Clean remains the owner of the products until the price (main amount and additional costs) has been paid in full. This circumstance in no way prevents the transfer of risk for loss and damage to the purchased products and any damage to the customer from the time they are handed over to him.

Article 10 – Product information

10.1 – General information

Keep it Clean publishes the information that relates to the essential characteristics of the products, Keep it clean publishes photos and / or videos of the products. Under certain circumstances, there may be slight deviations, especially with regard to the presentation, between the products shown on the website and the products delivered to the customer, since these are handmade products.

Article 11 – Warranty for material defects

If the products are defective, the customer is entitled to the statutory warranty claims.

Article 12 – Disputes and Liability

In the case of legally prescribed no-fault liability (e.g. from a guarantee or according to the Product Liability Act), Schön Sauber remains liable without limitation. For simple and slight negligence, Schön Sauber remain liable only in the event of a breach of cardinal obligations, i.e. those obligations that are to be granted to the customer according to the meaning and purpose of the specific contract or the fulfillment of which enables the proper execution of the contract in the first place and compliance with which the customer requires can trust regularly

The products sold on the website are only intended for private, but not for commercial use.

Article 13 – Intellectual property

The content of the website (text, logos, image and / or sound material, …) is the property of Schön Sauber Stay and its partners and is subject to the applicable provisions on the protection of intellectual property. The content may not be copied, reprinted or otherwise reproduced, passed on or recorded in any form without the prior written permission of Schön Sauber Stay.

Furthermore, the customer is not entitled to access the content of the database or any other elements of the website and publish the same, unless this is done in the context of non-commercial and private use.

Article 14 – Divisibility of the provisions (severability clause)

Should one or more of the above provisions be or become ineffective, the remaining provisions of these Conditions of Participation and the contract as a whole remain unaffected.

In this case, the contracting parties undertake to replace the invalid provision with one that is most economically beneficial to the intended purpose of the contract.

Article 15 – Governing Law and Jurisdiction

German law applies exclusively to the contractual relationship that exists between Keeping Nice and the customer and the rest of the legal relationship. The UN Sales Convention (CISG) and any other international agreements, even after they have been adopted into German law, do not apply.

If customers do not have a general place of jurisdiction in Germany or have moved their domicile or usual place of residence outside of Germany after conclusion of the contract or if their place of residence or usual place of residence is not known at the time the action is brought, the place of performance and place of jurisdiction is the registered office of Schön Sauber Stay Germany.
